  • The name of this competition is [Gelata Roma Valentine's Month competition 2024] (the "Competition").
  • The Competition is operated by Dairymaid (South Africa) (Proprietary) Limited (“Dairymaid”).
  • The Competition is governed by these terms and conditions (the “Rules”).
  • Each entrant ("Participant") is encouraged to review the Rules before entering into the Competition and acknowledges that they have been given an appropriate opportunity to do so and that they understand and accept these Rules.
  • Only persons who submit a valid entry in terms of Rule 3.2 and comply with the provisions of the Rules are eligible to participate in this Competition. Submission of a valid entry, in accordance with these rules, constitutes "Participation", and "Participate" and "Participating" have corresponding meanings.
  • Participation in the Competition constitutes acceptance of these Rules and each Participant agrees to be bound by these Rules.




  • This Competition is valid only in South Africa, and is open to any South African resident or person with a valid South African work permit, who is 18 years of age or older, but not those persons listed in Rule 2.3.
  • Each Participant must be in possession of a valid South African ID book, South African passport, or work permit (as applicable), which will need to be provided as certified proof of identification.
  • The Competition is not open to:
    • directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters or any other person who directly or indirectly controls or is controlled by, the Promoters;
    • people who are not legal residents and/or legal citizens of the Republic of South Africa;
    • any supplier of goods or services in connection with the Competition; and
    • any spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified above.
  • By submitting an entry into this Competition, each Participant confirms eligibility to participate and to claim a prize under these Rules. The Promoter may require a Participant to provide proof of such eligibility.
  • As far as the law allows, the Promoter reserves the right to require each winner and any other person who uses, receives, participates in or benefits from a prize ("Partner") to complete and sign a written release and indemnity document prior to claiming and/or using, receiving, participating in and/or benefitting from a prize.




  • The Competition will commence at 08:00 on 1 February 2024 and will end on 29 February 2024 at 23:59 (the "Competition Period"). Any entry received after the expiry of the Competition Period will be automatically disqualified and will not be considered. No late entries will be accepted.
  • To Participate in this Competition, Participants will be required to do the following during the Competition Period:
    • Buy at least one Qualifying Gelata Roma Product (as defined in 3.4 below), from any retailer, and retain the till slip as evidence of the purchase.
    • Dial the USSD number *120*15409# or SCAN the QR code on pack and follow the prompts.
  • All information, documents and materials submitted by a Participant for purposes of Rule 3.2 shall constitute such Participant's "entry" for purposes of these Rules.
  • Qualifying Gelata Roma Products mean:
  • GELATA ROMA Tin Roof 1.5L
  • GELATA ROMA Chocolate Brownie 1.5L
  • GELATA ROMA Stracciatella 1.5L
  • GELATA ROMA Cookies 1.5L
  • GELATA ROMA Caramel Delight 1.5L
    • Participants will be required to provide the till slip as evidence of purchase. Each till slip may only be used once for entry to the Competition
    • Participants may enter the Competition as many times as they wish over the Competition Period, subject to Rule 3.8 and provided that Participants purchase a Qualifying Gelata Roma Product each time and complete the entry contemplated in Rule 3.2.
    • There is no fee or charge for Participating in the Competition, other than the cost of Participants accessing, using, and uploading the entry via the Internet and entries via USSD are charged at 20c per 20 seconds
    • Participants will be limited to only one weekly entry per household and per person.
    • An entry will only be accepted if it complies with all entry requirements. The Promoter is entitled to reject entries which are:
      • automatically generated by computer;
      • completed by third parties or in bulk;
      • illegible or have been altered, reconstructed, forged or tampered with;
      • photocopies and not originals; and/or
    • To enable submission of the entry in the manner required in these Rules, the Participant may need to have necessary hardware, software and/or Internet access, and also an active account with one or more specified social media platforms (for example, Facebook, Twitter and/or Instagram) ("Platform")
    • Participant must comply with all applicable laws in participating in this Competition and/or in claiming, using and/or benefitting from any prize. Also, if participation (or any other step in the administration of this Competition as contemplated in these Rules) occurs directly or indirectly by means of any Platform, then Participant:
      • undertakes to comply, and warrants compliance with, all terms of use and rules of such Platform, as amended from time to time; and
      • Participant acknowledges that the Competition is not sponsored, endorsed, administered by or associated in any way with the Platform, nor does the Platform have any responsibility relating to the lawful operation of the Competition.


  • Participants who purchase a Qualifying Gelata Roma Product and complete the entry contemplated in Rule 3.2 stand the chance to win 1 OF 5 (5x couples or 5x pairs) Hot Air Balloon experiences in your city to the value of R10,000 each (Ten Thousand Rand). Upon a winner selection the experience will be booked for the couple/pair in the region of their choice. A couple/pair implies 2 individuals consisting of any relationship i.e.. Husband and wife, boyfriend and girlfriend, two friends, dad and son, mum and daughter etc. As a winner the choice is upon you to select the individual of whom you would like to take on the experience.
  • The prize winners will need to provide images of their luxurious getaway for purpose of social media use.
  • The prize must be redeemed by the 15th of March 2024 and used by the 30th of April 2024.
  • As far as the law allows, all warranties and representations in relation to the prize/s not set out in these Rules (whether express, implied or tacit) are hereby excluded.
  • As far as the law allows, the Promoter shall only be responsible for the maximum amount per prize as specified in these Rules. The winner is responsible for (i) any and all applicable local taxes and fees (and independent financial advice should be sought for such purpose); and (ii) all other costs incurred by the winner, or arising directly or indirectly from, the participation in the Competition.
  • The prize winner/s may not request a different prize, and the Promoter will not replace any lost, mutilated, or stolen prizes. All prizes are non-transferable, non-refundable, not negotiable and no substitutions will be made except as provided herein. The Promoter reserves the right to substitute any prize for another of comparable or greater value.




  • The prize winners will be selected at random by way of a computer-generated draw conducted by the Promoter or a person appointed by the Promoter.
  • The draw to determine and/or select the prize winner will take place on the following dates:
  • 8th February 2024
    • 1 Winner will be drawn (1 couple/pair)
  • 15th February 2024
    • 1 Winner will be drawn (1 couple/pair)
  • 22nd February 2024
    • 1 Winner will be drawn (1 couple/pair)
  • 29th February 2024
    • 1 Winner will be drawn (1 couple/pair)
  • 7th March 2024
    • 1 Winner will be drawn (1 couple/pair)


  • The winner may be requested that his/her name be used for other marketing purposes, but the winner is entitled to decline to do so.
  • The Promoter's selection and/or determination of the winner/s shall be final and no correspondence will be entered into.
  • The Promoter reserves the right to require a winner to provide additional information reasonably required to confirm the identity of the winner and/or to process and/or facilitates the winner's use and/or benefit of the prize.
  • The Promoter will attempt to contact the winner as soon as practicable, using any of the contact details provided in the entry. The Promoter will use reasonable endeavours to notify the winner by telephone, WhatsApp, Instagram or, Facebook.
  • The potential prize winners are not an actual winners until his/her submission is validated and his/her documents are completed and submitted to the Promoters. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the Rules herein. Valid till slips will be requested from potential winners. Failure to provide a valid till slip will result in the individual forfeiting the prize.
  • If the Promoters are unable to reach any of the potential prize winners after 3 (three) attempts made within 3 (three) working days of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the Rules herein.
  • Eligible winners will have their prizes delivered to them by a representative of the Promoters based on the information they will have shared via the above mentioned telephonic conversation.
  • All winners need to allow for 1 week for delivery of their prizes to their physical addresses.


    • The Promoter does not claim any rights of ownership in a Participant's entry.
    • By submitting an entry (including accompanying material such as videos, photographs and/ or proof of the Experience in Rule 4.3), the Participant:
      • warrants that he or she owns all intellectual property rights (including copyright) and moral rights in and to such entry and all materials comprising such entry, wherever arising anywhere in the world, or that he or she has the right to use them as contemplated in these Rules and to grant the rights contemplated in these Rules; and
      • hereby grants to the Promoter a non-exclusive, worldwide, irrevocable and perpetual right and licence to do the following (which Promoter may in its discretion elect to exercise) in respect of the Participant's entry (in whole or in part):
    • to make it available on any Platform or other medium or social media platform, whether now known or invented in the future, for purposes of administering the Competition, promoting and/or marketing the Competition and for any future promotional and/or marketing campaigns and/or for any purposes whatsoever (collectively the "Purpose"); and
    • to use, copy, modify, adapt, collate, display, publish, distribute, transmit, store, archive, and/or re-format such entry for the Purpose; and
    • to grant any other person a sub-licence to do any act contemplated in this Rule 6.2.2.




  • The Promoter reserves the right, acting reasonably, to amend the rules of the Competition by notification at any time during the Competition.
  • The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Subject to applicable law, should the winner be found, in the Promoters sole discretion: not to be eligible to win; not to have complied with these Rules; their conduct can be reasonably interpreted as scamming; acted fraudulently with regards to the Competition; and if it would be unlawful to award the prize, he/she will automatically be disqualified and/or the prize will be forfeited. Prize winners may also be required to sign acceptance of prizes and indemnity documents.
  • The prize is not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.
  • The Promoters reserve the right, at their sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
  • By entering, a Participant acknowledges that personal information about the Participant will be shared with the Promoters and their agents to the extent necessary to conduct the Competition and for prizes to be delivered to prize winners.
  • By entering this Competition you authorise the Promoters to collect, store and use (not share) personal information of Participants for communication or statistical purposes. You are entitled to decline any marketing communication by emailing [email protected]. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Dairymaid’s privacy policy.
  • Participants may be required to take part in publicity campaigns for broadcast or publishing Participants shall at all times be entitled to decline the above request. Participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Promoters.
  • Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
  • All Participants participate entirely at their own risk. By entering into the Competition, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
  • The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
  • The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
  • The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Competition and acknowledge that they will have no recourse against the Promoters, their advertising agencies, advisors, suppliers and nominated agents.
  • By entering the Competition, Participants acknowledge that the Competition will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
  • Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.
  • These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any Participant and Dairymaid consent to the non-exclusive jurisdiction of the High Court of South Africa.
